Terms & Conditions

1. Vimal Travels is engaged as the Contractor for Provision of Transportation and other services specified in The Transport Duty Slip/Coupon.

2. The Transport Duty Slip/Coupon is issued to the patron named overleaf and would be valid for undertaking the tour/journey subject to the terms and conditions hereof and all terms and conditions set forth and annexed to the itinery of the said tour.

3. The Duty Slip/Coupon is subject to any and all tariffs, terms and conditions, including the provision of The Motor Vehicles Act, 1998, under which any transportation or any other services whatsoever are provided by such contractors.

4. By acceptances of this duty slip/coupon, the patron agrees to undertake the journey/tour at his/her sole risk and responsibility and also agrees that neither the Company nor any affiliated or subsidiary companies shall be or become liable or responsible for and loss, injury or damage to a person or property in connection with any transportation or other service resting directly or indirectly or otherwise from the acts of God, danger incidental to surface travel, sea fire, breakdown in transport vehicle, mechanical or equipment, acts of Government and other authorities, war civil disturbances, riots, thefts, pilferage, epidemic quarantines, customs, regulation delays or cancellation, of or changes in itinery or schedule or from any causes beyond VIMAL TRAVELS control or for any or omission of the contractor or any of its agents or servants or for any loss or damage resulting from improper passports, visas or other documents and that neither VIMAL TRAVELS nor any of its affiliated or subsidiary companies shall be or become liable or responsible for any additional expenses or any of the foregoing causes.

5. The patron thereof does herby, for himself or herself and his or her legal representatives, heirs, release and absolve VIMAL TRAVELS and its officers, agents and employees from any and all liabilities for proper or damage or from any and all damages resulting from death or personal injuries including loss or services, means which he or she may sustain, on account of arising out of or while engaged on any tour of transportation or other services, whether due to ownership maintenance, use, operation or control of any other vehicle or there wise and whether or not due to its or their negligence or otherwise and regardless of the cause.

6. The Patron hereof does hereby declare, confirm and acknowledgement the VIMAL TRAVELS shall have the right for any reason whatsoever and in its sole discretion to cancel the Duty Slip/Coupon and any tickets issued under or pursuant there to and in the event of such cancellation VIMAL TRAVELS only liability to the patron shall be to refund to the Patron the unused value thereof.

7. The applicable law shall be the law of India Court in Mumbai, India shall have the exclusive jurisdiction in respects of any dispute arising out of this contract. LIABILITY CLAUSE The Company/Hotel in whose name the Bill is raised, as well as the person/s availing the services, shall be jointly and severally liable to make payment of the bill raised by VIMAL TRAVELS for the services rendered by them.
